1. About STRAPD

These Terms of Service apply to your use of STRAPD.ie and to purchases made through our online store.

STRAPD is operated by STRAPD LIMITED, an Irish private company limited by shares.

References in these Terms to “STRAPD”, “we”, “us” or “our” mean STRAPD LIMITED.

Nothing in these Terms excludes, restricts or otherwise affects any mandatory rights available to consumers under Irish law.

2. Consumers and Business Customers

A consumer is an individual acting mainly for purposes outside their trade, business, craft or profession.

A business customer includes a club, team, clinic, company, organisation, professional, practitioner or other customer purchasing mainly for purposes connected with its business, profession, trade or organisational activities.

Certain statutory rights referred to in these Terms apply specifically to consumers and do not necessarily apply to business customers.

3. Using Our Website

You may use STRAPD.ie only for lawful purposes.

You must not:

intentionally interfere with the operation, availability or security of the website;
introduce viruses, malware or other harmful technology;
attempt to gain unauthorised access to our website, systems or accounts;
fraudulently use another person's identity, payment information or personal information;
use the website in a way that infringes the rights of STRAPD LIMITED or another person; or
use the website for any unlawful or fraudulent purpose.

We may restrict or suspend access to the website where reasonably necessary to protect STRAPD, our customers, other users or our systems.

Any such restriction does not remove rights relating to an order already accepted by us.

4. Products and Product Information

We take reasonable care to ensure that product descriptions, dimensions, specifications, photographs and prices displayed on our website are accurate.

The colour, appearance or packaging of products may vary slightly from images displayed online due to factors including lighting, screen settings, manufacturing tolerances and packaging updates.

Nothing in these Terms limits your statutory rights relating to the description, quality, durability, fitness for purpose or conformity of goods.

Product information, articles, application guidance and other content provided by STRAPD are provided for general information purposes.

They are not intended to diagnose or treat any medical condition and are not a substitute for individual advice from an appropriately qualified healthcare professional.

Products should be used in accordance with their labelling, packaging and any instructions or warnings supplied with them.

5. Orders and Formation of Contract

When you place an order through STRAPD.ie, you are making an offer to purchase the products contained in that order.

An automated order acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it.

Unless we expressly tell you otherwise, a contract between you and STRAPD LIMITED is formed when we confirm that your order has been accepted or dispatched.

Payment may be authorised or collected before dispatch.

If payment has been taken and we are subsequently unable to accept your order, we will refund the relevant payment.

We may decline or cancel an order before acceptance for reasonable reasons including:

product unavailability;
an obvious pricing or description error;
suspected fraud or unauthorised payment;
payment failure;
delivery restrictions;
unusual or potentially abusive ordering activity; or
a legal or regulatory restriction.

Where we cancel an order after receiving payment, we will notify you and refund the amount paid for the cancelled products.

6. Prices and Payment

The price charged for a product will normally be the price displayed when you place your order, subject to correction of an obvious error before acceptance of the order.

Any applicable delivery charge will be displayed before you complete checkout.

STRAPD LIMITED is currently not VAT registered. We therefore do not charge or separately state VAT on our sales and do not display a VAT registration number.

If our VAT status changes, our pricing, checkout settings and documentation will be updated as required.

You must provide accurate billing and payment information and must be authorised to use the payment method selected.

Payments may be processed by Shopify Payments or another payment service provider made available through our checkout.

7. Delivery

We currently deliver within Ireland unless otherwise stated on our website.

Available delivery methods, charges and estimated delivery times are described in our Shipping Policy and at checkout.

Delivery dates and times are estimates unless we expressly agree otherwise.

For consumer orders, where no different delivery period has been agreed, applicable Irish consumer law provides rights concerning timely delivery.

For consumer purchases, goods generally remain at STRAPD LIMITED's risk until you, or a person nominated by you other than a carrier independently commissioned by you, takes physical possession of them.

If a parcel is delayed, lost or arrives damaged, please contact us at sales@strapd.ie so that we can investigate the matter.

8. Cancellation, Returns and Refunds

Our Return and Refund Policy forms part of these Terms and explains our procedures for cancellations, change-of-mind returns, faulty goods and refunds.

Consumers purchasing goods online generally have a statutory right to cancel qualifying purchases within 14 days of receiving the goods, without having to provide a reason, subject to applicable statutory exceptions.

After notifying us of a qualifying cancellation, the consumer must return the goods within the applicable statutory period and in accordance with our Return and Refund Policy.

Certain products or circumstances may be excluded from the statutory cancellation right where permitted by law.

Nothing in these Terms or our Return and Refund Policy limits your statutory rights in respect of faulty, damaged, misdescribed or non-conforming goods.

9. Faulty, Damaged or Non-Conforming Goods

STRAPD LIMITED is responsible for supplying consumers with goods that conform to their contract and applicable consumer law.

If goods are faulty, damaged, incorrect, not as described or otherwise fail to conform to the contract, please contact:

Your statutory remedies will depend on the circumstances, including when the problem becomes apparent and the nature of the lack of conformity.

Applicable remedies may include:

repair;
replacement;
price reduction;
cancellation of the contract; or
refund.

Nothing in these Terms reduces or replaces any remedy to which a consumer is entitled under Irish law.

10. Club, Team, Physio and Business Orders

Orders placed by clubs, teams, clinics, companies, practitioners or other organisations are treated as business purchases where the purchaser is acting mainly for purposes related to its trade, profession, business or organisational activities.

Statutory rights that apply specifically to consumer contracts, including consumer change-of-mind cancellation rights, do not apply to transactions that are not consumer contracts.

Where STRAPD LIMITED provides a separate:

quotation;
club or trade price;
payment arrangement;
volume discount;
credit arrangement; or
written supply agreement,

those specifically agreed terms will form part of the contract and will take priority over any inconsistent provision of these general Terms.

Unless otherwise agreed by STRAPD LIMITED, business customers do not have an automatic change-of-mind return right.

Nothing in this section removes any contractual rights a business customer may have where goods fail to meet an expressly agreed specification.

11. Intellectual Property

The STRAPD name, branding, logos, website design, original photographs, graphics, videos, text and other original content are owned by or licensed to STRAPD LIMITED and are protected by applicable intellectual-property laws.

You may use our website for personal use and legitimate purchasing or business-enquiry purposes.

Unless permitted by law or authorised by us, you may not:

reproduce;
republish;
distribute;
commercially exploit;
modify; or
use STRAPD branding or original content

without our prior permission.

Shopify and other third-party names and trademarks remain the property of their respective owners.

12. Reviews, Testimonials and Feedback

If you submit a product review, testimonial or other feedback for publication through STRAPD.ie, you grant STRAPD LIMITED a non-exclusive, royalty-free right to reproduce and display that material in connection with STRAPD and its products.

You must not submit content that is:

unlawful;
defamatory;
knowingly false or misleading;
threatening or abusive;
infringing of another person's intellectual-property or privacy rights; or
otherwise unlawful.

We may moderate or remove submitted content where reasonably necessary.

Where we wish to use a customer's photograph, video or other substantial user-generated content for separate advertising or promotional campaigns outside the context in which it was originally submitted, we may seek additional permission where appropriate.

13. Shopify and Third-Party Services

Our online store is hosted by Shopify.

We may also use third-party providers for services including:

payment processing;
website functionality;
delivery and fulfilment;
email communications;
analytics; and
marketing.

When you purchase products through STRAPD.ie, your sales contract is with STRAPD LIMITED, not Shopify.

Third-party services and external websites may be subject to their own terms and privacy policies.

STRAPD LIMITED is not responsible for the content or operation of independent third-party websites merely because they are linked from STRAPD.ie.

Nothing in this section excludes or limits any responsibility that cannot lawfully be excluded.

14. Liability

Nothing in these Terms excludes or limits:

your statutory rights as a consumer;
liability for fraud or fraudulent misrepresentation;
liability for death or personal injury where such liability cannot lawfully be excluded;
liability arising under applicable product-liability legislation where it cannot lawfully be excluded; or
any other liability that applicable law does not permit us to exclude or restrict.

To the extent permitted by law, STRAPD LIMITED is not responsible for loss or damage caused solely by misuse of a product contrary to its instructions, warnings or intended use.

For consumer contracts, we do not exclude liability for losses that are a reasonably foreseeable consequence of our breach of contract or failure to exercise required care.

For business customers, and to the maximum extent permitted by law, STRAPD LIMITED will not be liable for indirect or consequential business losses, loss of profits, loss of revenue, loss of anticipated savings or loss of business opportunity arising in connection with an order.

Any exclusion or limitation applicable to business customers remains subject to liabilities that cannot lawfully be excluded or limited.

15. Website Availability

We aim to keep STRAPD.ie available, secure and accurate, but we do not guarantee that the website will always operate without interruption or technical error.

We may temporarily suspend, maintain, update or modify website functionality.

Where reasonably possible, maintenance and changes will be carried out in a manner that minimises disruption.

Temporary website unavailability does not affect rights relating to orders already accepted by STRAPD LIMITED.

16. Privacy and Cookies

We process personal information in accordance with our Privacy Policy.

Our use of cookies and similar technologies is described in our Privacy Policy and through the privacy and cookie controls made available on STRAPD.ie.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes to:

our business;
our products or services;
website functionality;
legal or regulatory requirements; or
our operating practices.

Updated Terms will take effect from the date stated at the top of the revised version.

Changes will generally apply to future use of STRAPD.ie and future orders.

An order already accepted will ordinarily remain governed by the Terms applicable when the relevant contract was formed unless applicable law requires otherwise.

18. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary.

The remaining provisions will continue to apply to the maximum extent permitted by law.

19. Governing Law

These Terms are governed by the laws of Ireland.

If you are a consumer, nothing in these Terms:

deprives you of mandatory protections available under applicable consumer law; or
requires you to bring proceedings in a court that would not otherwise have lawful jurisdiction.
